This Privacy Policy explains how Appcesa collects, uses, stores, and protects personal data submitted through our website at appcesa.com or provided during the course of our services. It applies to all individuals who interact with our website, contact us by email or phone, or engage with us as clients.

This policy is prepared in accordance with the Egyptian Personal Data Protection Law No. 151 of 2020 (PDPL) and its executive regulations, which govern the collection and processing of personal data of individuals in Egypt. We are committed to handling your data with transparency, care, and respect.

Personal Data We Collect

We collect personal data only where necessary to provide our services or to respond to enquiries. The categories of data we may collect include:

Contact and identification data: Name, email address, phone number, and any information you provide voluntarily through our contact form or direct communications.

Health and fitness information: Where relevant to providing personal training services, clients may share health history, fitness goals, physical limitations, and similar information. This falls under sensitive personal data under the PDPL and is handled with heightened protections.

Technical data: IP address, browser type, device type, operating system, pages visited, and session duration. This data is collected automatically when you visit our website through cookies and similar technologies.

Communication records: Records of correspondence between you and Appcesa, including emails and contact form submissions.

We do not collect financial payment data directly. Any payment processing is handled through third-party providers with their own privacy policies.

Under Egyptian Personal Data Protection Law No. 151 of 2020, we process personal data on the following legal bases:

Consent: Where you have provided explicit consent, such as when submitting our contact form and ticking the consent checkbox, or when accepting non-essential cookies through our cookie consent tool.

Contractual necessity: Where processing is necessary to fulfil our obligations under a service agreement with you as a client, including scheduling sessions, designing your program, and maintaining training records.

Legitimate interests: Where processing is necessary for our legitimate business interests, such as improving our website, communicating about our services, and maintaining basic business records, provided these interests are not overridden by your rights.

Legal obligation: Where processing is required to comply with applicable Egyptian law or regulations.

How We Use Your Data

Personal data collected by Appcesa is used for the following purposes:

Responding to enquiries submitted through our contact form or by email. Arranging and managing initial consultations and ongoing training sessions. Designing and maintaining your personal training program and progress records where you are a client. Improving the functionality and user experience of our website. Complying with legal and regulatory obligations under Egyptian law. Communicating information about our services where you have consented to receive such communication.

We do not use your personal data for automated decision-making or profiling that would produce legal or similarly significant effects. We do not sell or rent personal data to third parties.

Sensitive Health Data

As a fitness service, we may collect information about your physical health, medical history, injuries, or health conditions where relevant to designing a safe and appropriate training program. This information constitutes sensitive personal data under Article 4 of the Egyptian PDPL.

We process this category of data only with your explicit consent, which is obtained separately and specifically. You may withdraw this consent at any time. We take additional security measures to protect health-related data, including restricting access to only those directly involved in your training.

Health information shared with us is used solely for the purpose of safe and appropriate program design and delivery. It is never shared with third parties without your explicit consent, except where required by Egyptian law.

Data Sharing and Third Parties

We do not sell, trade, or transfer your personal data to outside parties for commercial purposes. We may share data with trusted third-party service providers who assist in operating our website and business, subject to confidentiality obligations. These may include:

Web hosting and infrastructure providers. Email service providers used for correspondence. Analytics platforms (where consent has been given for analytical cookies). Payment processors where applicable.

All third-party processors are required to handle your data in accordance with applicable data protection law. Where data is transferred outside Egypt, we ensure appropriate safeguards are in place consistent with the requirements of the Egyptian PDPL and its executive regulations.

Data Retention

We retain personal data only for as long as necessary to fulfil the purposes for which it was collected or as required by Egyptian law.

Enquiry and contact data for non-clients is retained for a maximum of twelve months, after which it is securely deleted unless you have become a client. Client training records are retained for the duration of the service relationship and for a reasonable period thereafter to address any questions or disputes. Technical and analytical data is retained in accordance with our cookie policy. Financial and transaction records are retained for the period required by Egyptian tax and commercial law.

You may request deletion of your personal data at any time by contacting us, subject to any legal retention obligations that may apply.

Your Rights Under Egyptian Law

Under the Egyptian Personal Data Protection Law No. 151 of 2020, you have the following rights in relation to your personal data:

Right of access: You may request a copy of the personal data we hold about you.

Right to rectification: You may request correction of inaccurate or incomplete data.

Right to erasure: You may request deletion of your data where there is no legitimate basis for continued processing.

Right to restrict processing: You may request that we limit how we use your data in certain circumstances.

Right to withdraw consent: Where processing is based on consent, you may withdraw that consent at any time without affecting the lawfulness of prior processing.

Right to lodge a complaint: You have the right to submit a complaint to the Egyptian Personal Data Protection Center (PDPC) established under the PDPL if you believe your rights have been violated.

Data Security

We implement appropriate technical and organisational measures to protect personal data against unauthorised access, disclosure, alteration, or destruction. These measures include secure hosting infrastructure, access controls, and regular review of our data handling practices.

Despite these measures, no internet transmission or electronic storage system is completely secure. If you have reason to believe that your interaction with us is no longer secure, please contact us immediately at info@appcesa.com.

In the event of a data breach that poses a risk to your rights, we will notify you and the relevant Egyptian regulatory authority in accordance with the obligations set out in the PDPL.
